Ecarpets (Wilsons Furnishers LTD) Terms & Conditions

The following terms and conditions apply to all transactions carried out by you on Ecarpets Web Site. By entering this Web Site and making your first purchase, you accept these terms and conditions.


DEFINITIONS

"Buyer" means any person who is purchasing outside the course of his or her business or trade."Goods" means floor coverings available for purchase via Ecarpets website. "We" or "us" refer to Wilsons Furnishers Limited.


DELIVERY RESTRICTIONS

The Ecarpets Web Site is intended to be used and accessed in the UK only. Standard delivery is to Mainland England, Wales & Scotland (Excluding the Highlands). Unfortunately due to courier restrictions a surcharge must be applied to offshore locations, the highlands and Northern Ireland. We do not accept any orders outside the UK.

All delivery times are given in good faith and are not guaranteed. The majority of items do arrive on the next working day, but external circumstances out of our control may delay delivery. We are not liable for any cost incurred due to a delayed delivery. Because of this you should not arrange a fitting date until you have received and checked your flooring.


PLACING ORDERS

On placing an order via Ecarpets , you warrant to us that you are a Buyer. The goods displayed and information about our products including prices on Ecarpets website is an invitation to you to buy. An order is placed when you have completed and submitted a Buy Now action via our various ‘Payment Methods’ and subsequently agreed to the cost provided to you by Ecarpets.

All orders shall be acknowledge by a receipt by way of an e-mail or a telephone confirmation. All orders shall be accepted by Ecarpets when you receive our e-mail or telephone acknowledgement. Should you receive confirmation of an order that you did not place, or if the details in the confirmation do not match the order which you placed or intended to place, or you have reason to query or cancel the order for whatever reason, you must contact our customer services team within 12 hours by telephone or e-mail to cancel the order or correct the details. All quotes and orders will be based upon the measurements provided by you the customer, should you not feel confident of your measurements please inform Ecarpets customer services. We reserve the right to cancel any orders which we are unable to fulfill.


PRICE AND PAYMENT METHODS

All prices are in pounds sterling. Payment must be made in pounds sterling. Payment by card is subject to authorisation by the card issuer. If such authorisation is refused to us, we will not be liable for any delay or non-delivery. Any omission or error in any sales literature, web page or site, order form, quotation, price list, order acknowledgement, dispatch note, invoice or other document issued by us may be corrected by us without liability.


PRICE MATCH GUARANTEE

When you buy from Ecarpets, you can be confident that we will not be beaten on price. If you find the same product available on a UK based website at a lower price than our own within 7 days of you placing your order, we will refund you the difference upon written proof of quote/purchase.


DELIVERY

We will do our very best to supply the Goods ordered by you within our recommended delivery timescales, and in any event will give a commitment to deliver on a set date. Our timescales will be taken from the date of receipt of payment made. All Goods are offered subject to availability. You will be advised of any delay in delivery if your Goods are not available. If your order cannot be fulfilled, we will give you a full refund. Deliveries will only be made to the ground floor only of any property. However exceptions can sometimes be made and arranged with Ecarpets prior to delivery. Please contact Ecarpets customer services straight away by telephone or email should your Goods not be delivered on the arranged day or the incorrect Goods are delivered. You will be required to check your goods for damaged upon delivery as you will need to sign off your satisfaction of the condition of the goods. Should you not be satisfied then you will need to contact Ecarpets customer services whilst the delivery driver present or sign for the items as damaged. Except where otherwise agreed by us in writing, delivery shall take place within the perimeters of your selected delivery requirements detailed at the stage of purchase. If you are not at the property you have detailed as the official delivery address on the agreed day that has been confirmed for delivery and a delivery has been attempted, then you will be liable for the full costs of delivery, and may be liable for the full costs for re-delivery. You shall provide Ecarpets directly or via one of its couriers, a full and safe access to the area where the services are to be provided. When delivering rolls of carpet we only offer a curb side delivery. Some drivers may help bring the items into the property but we cannot guarantee this. Deliveries to offshore locations, the Highlands & Northern Ireland are usually subject to a surcharge. Any parking charges will also be added to the final invoice, if not already supplied by the customer. The goods will usually be delivered to the ‘Buyers’ delivery address unless otherwise stated in writing. Ecarpets will attempt to deliver between the hours of 7.00am to 8.00pm on the day of delivery. But it must be stressed that we cannot guarantee a delivery time or date. We are not liable for any cost incurred due to a delayed delivery.


MEASUREMENTS

Whilst Ecarpets provide an online calculator to assist you in measuring the volume of carpet needed to cover your floor space in an attempt to save money, we do not accept any liability for inaccurate measurements used to purchase goods via Ecarpets. It is the sole responsibility of the ‘Buyer’ to provide the correct measurements prior to purchase.


CANCELLATIONS

If for any reason you wish to cancel your order for ‘Goods’ you must advise us no later than 24 hours after the initial order date. Any amounts paid for orders cancelled after this timescale will not be refundable. As a ‘Buyer’, there are certain terms implied into your agreement with us, which we cannot exclude or limit. For example, under the Sale of Goods Act 1979 (as amended) we must ensure that the Goods are of satisfactory quality. Nothing in these Terms and Conditions affect these statutory rights.


LIMITATION OF LIABILITY

Ecarpets shall accept no liability to you for any loss of or damage to any property or injury to or death of person caused by any negligent act or omission or willful misconduct of our couriers as we they are not our employees. If you have any complaints about Ecarpets ‘Goods’ or service offered via our website, we will be happy to hear from you. Please contact our customer services team at [email protected] for any support.


DATA PROTECTION

It is Ecarpets policy to take all necessary steps to ensure that personal data is processed fairly and lawfully. We will take all necessary steps to implement this policy. In order to process your order for ‘Goods’ we shall require your name, address, delivery address, (if different) telephone number and email address. We shall also require the information necessary for the payment by credit or debit card. The information that you provide for this purpose will be used for the processing of your order. No credit or debit card detail are stored Ecarpets shall hold this information for registered users until you notify us that you no longer wish to be a registered with Ecarpets. In addition, we would like to use your information to let you know about Ecarpets ‘Goods’, services and special offers. You may opt out of this use of your information by ticking the box on the relevant order page. We do not pass on personal details of our customers to third parties, employees, sub-contractors and agents whom we may use to deliver the Goods or supply the services.


FLOOR COVERING COLOURS/PATTERN MATCHING/INSTALLATION

Although Ecarpets will endeavour to supply ‘Goods’ in accordance with the colour charts shown on the website or samples posted out, we cannot guarantee the products supplied will be an exact colour match to those shown. It is therefore possible that minor differences may occur which are inherent in all produced products. These differences do not occur due to a default in the manufacture of Goods. We would bring your attention to the following matters that are characteristic to carpets and other floor coverings. Ecarpets will endeavour to colour match different carpet widths but cannot guarantee identical matches. Side-by-side pattern matching or consistent room to room linear design directions cannot be guaranteed.Pile carpets, especially those with plain grounds, are liable to shading, where light and dark patches arise due to uneven surface pressure. Shading is a natural occurrence in carpets and is not a manufacturing fault and will not affect its durability. We would point out that light and delicately shaded carpets are prone to becoming soiled in everyday wear. This may give the carpet an appearance of losing its colour. All cut pile fabrics of any fibre type will flatten due to use, particularly in areas of heavy footfall. Regular vacuuming will help to allay this. Pile flattening is a normal reaction to localized traffic and is not a manufacturing defect. Carpet seams will be present if the room or area exceeds the width of the carpet selected.


DISCLAIMERS

Ecarpets do not warrant that use of our website is entirely free from the risk of viruses or other damaging components. Where individual products are subject to additional warranties or guarantees given by their manufacturers, you are responsible for applying for the warranty in accordance with the manufacturer’s instructions. Such warranties are not enforceable against us, but only enforceable against the manufacturer. All ‘Goods’ ordered will be ordered to the exact sizes as provided via our buying system. We cannot accept any liability should any product ordered not fit due to any errors in the measurements provided.This does not affect your statutory rights with respect to Goods purchased from us.


DELAY OR FAILURE TO PERFORM

Ecarpets shall not be liable to you if we are prevented or delayed in the performing of any of our obligations to you if this is due to any cause beyond our reasonable control including (without limitation): extreme weather conditions, explosion, fire or accident; war or civil disturbance; strike, industrial action or stoppages of work; any form of government intervention; a third party act or omission; failure by you to give us a correct delivery address or notify us of any change of address.


GENERAL

These terms and conditions are subject to English Law and to the exclusive jurisdiction of the English courts. We may freely assign, subcontract or otherwise transfer in whole or in part the order PROVIDED THAT the quality of Goods and/or services supplied to you is not affected. You may not however do so without our written agreement. If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and Conditions and the remainder of the provision in question shall not be affected thereby.*The provisions of the Contracts (Rights of Third Parties) Act 1999 are expressly excluded so that no third party may claim any rights under these Terms and Conditions.
